Federal Court stay decision – 18 October 2024

On 18 October 2024, the Federal Court dismissed Greenbot’s application for a further stay of the Clean Energy Regulator’s (CER) decision to suspend Greenbot as a registered person. The CER suspended Greenbot’s registration on 11 June 2024 and this decision was stayed by the Court on 3 July 2024.

This means that Greenbot can no longer create renewable energy certificates as of 18 October 2024. The Court has continued the stay on the CER’s decision to terminate the deed allowing Greenbot to be an app provider under the Solar Panel Validation (SPV) Initiative. The Court’s order means that Greenbot will be allowed to participate in the SPV Initiative while the Court is reviewing the matter. We will keep you updated as further information becomes available.

On 11 June 2024, the Clean Energy Regulator (CER) suspended the registration of Greenbot Pty Ltd (Greenbot) under section 30A of the Renewable Energy (Electricity) Act 2000. Greenbot can no longer create renewable energy certificates (certificates). 

The decision follows an investigation into the conduct of Greenbot including the administration of its online trading portal and mobile telecommunication application (together being the Greenbot platform). The platform facilitates the creation of certificates in the CER’s REC Registry.

The CER has suspended Greenbot because it is satisfied that Greenbot is not a fit and proper person. 

The CER understands that its decision, while a consequence of Greenbot’s conduct, may impact rooftop solar retailers. Those affected can access further information on the CER’s website.
