Following consideration of submissions received during a public consultation process (7 November to 6 December 2022) required under the Renewable Energy (Electricity) Regulations 2001 (the Regulations), the Clean Energy Regulator (CER) will open an application process with a view to nominating one product listing body.
Opening an application process to nominate a product listing body creates a competitive process. An application process also aligns with the recommendations from the Integrity Review of the Rooftop Solar PV Sector and the outcomes of the solar product listing consultation. The application process for a product listing body should not be construed as pre-empting the decision on which body will be nominated to undertake the product listing function.
The CER received 175 submissions during the product listing consultation process. The majority of submissions indicated a preference for the CER to open an application process to nominate a product listing body. Strong arguments were made for both options; proceeding with an application process to nominate a body or to simply leave the 'status quo' with the Clean Energy Council (CEC) remaining as the listing body. The Regulations allow the CER to nominate one organisation to publish lists of approved solar products (solar PV modules and inverters). The application process will be conducted in accordance with Regulation 20AE of the Regulations. The CEC will continue to publish lists of approved products at least until the application process is complete and a body is nominated by the CER. The CEC may also choose to submit an application as part of the competitive application process.
The CER will release further information about the nomination process and open a 3-month application round from May or June 2023.
