We undertake activities to ensure compliance with the requirements of the Renewable Energy (Electricity) Act 2000.
In the Small-scale Renewable Energy Scheme, these activities range from extensive automated checks and the validation of claims via supporting documentation through to investigations and enforcement action.
Under the Renewable Energy (Electricity) Regulations 2001, we may declare a person or product ineligible to participate in the Small-scale Renewable Energy Scheme. We may also make a declaration in conjunction with other compliance or civil/criminal action.
A declaration means:
- for an installer, any small generation unit (typically solar panel systems) installed by that person will not be eligible to receive small-scale technology certificates (STC).
- for a retailer, any small generation units (typically solar panel systems) retailed by them will not be eligible for STCs
- that an inverter or solar module is not eligible for STCs.

Circumstances
Between 15 August 2022 and 6 June 2023, Mr Chew provided false installer written statements claiming he was the accredited installer or supervisor of 12 solar PV system installations.
The CER found that Mr Chew failed to meet the Clean Energy Council’s onsite requirements for a person responsible for installing or supervising a solar PV system installation.
Keng Soon Chew has been declared ineligible to install small generation units for the purposes of sub-regulation 20AC(2) of the Regulations for a period of 12 months.

The Clean Energy Regulator found that Mr Coulthard did not attend the installations and failed to meet the Clean Energy Council’s onsite requirements for a person responsible for installing or supervising a solar PV system installation.
David Coulthard has been declared ineligible to install small generation units for the purposes of sub-regulation 20AC(2) of the Regulations for a period of 12 months.

Greenbot agent suspension
The Clean Energy Regulator permanently suspended the Greenbot Pty Ltd as a registered person on 11 June 2024. Greenbot can no longer create renewable energy certificates.

Federal Court stay decision – 18 October 2024

On 18 October 2024, the Federal Court dismissed Greenbot’s application for a further stay of the Clean Energy Regulator’s (CER) decision to suspend Greenbot as a registered person. The CER suspended Greenbot’s registration on 11 June 2024 and this decision was stayed by the Court on 3 July 2024.
This means that Greenbot can no longer create renewable energy certificates as of 18 October 2024.
The Court has continued the stay on the CER’s decision to terminate the deed allowing Greenbot to be an app provider under the Solar Panel Validation (SPV) Initiative. The Court’s order means that Greenbot will be allowed to participate in the SPV Initiative while the Court is reviewing the matter. We will keep you updated as further information becomes available.
