We undertake activities to ensure compliance with the requirements of the Renewable Energy (Electricity) Act 2000.

In the Small-scale Renewable Energy Scheme, these activities range from extensive automated checks and the validation of claims via supporting documentation through to investigations and enforcement action.

Under the Renewable Energy (Electricity) Regulations 2001, we may declare a person or product ineligible to participate in the Small-scale Renewable Energy Scheme. We may also make a declaration in conjunction with other compliance or civil/criminal action.

A declaration means:

  • for an installer, any small generation unit (typically solar panel systems) installed by that person will not be eligible to receive small-scale technology certificates (STC).
  • for a retailer, any small generation units (typically solar panel systems) retailed by them will not be eligible for STCs
  • that an inverter or solar module is not eligible for STCs.

Declarations

We publish all current and expired declarations under our compliance policy for education, monitoring and enforcement activities. The below list of installers, retailers and products includes all declarations, including the period they are ineligible to participate in the scheme.

Circumstances

On 30 April 2024, Mr Rohit Kumar Jafal was prosecuted and convicted in contravening Regulation 52B(9)(b) of the Electricity (Licensing) Regulations 1991 (WA). 

Following the conviction, the Clean Energy Regulator found that on 25 occasions, Mr Jafal provided false or misleading statements and materially breached local, state or territory government requirements for the installation of solar PV installations.

Mr Jafal has been declared ineligible to install small generation units for the purposes of sub-regulation 20AC(2) of the Regulations for 3 months.

Circumstances

Between 15 August 2022 and 6 June 2023, Mr Chew provided false installer written statements claiming he was the accredited installer or supervisor of 12 solar PV system installations.

The CER found that Mr Chew failed to meet the Clean Energy Council’s onsite requirements for a person responsible for installing or supervising a solar PV system installation.

Keng Soon Chew has been declared ineligible to install small generation units for the purposes of sub-regulation 20AC(2) of the Regulations for a period of 12 months.

Between 1 February 2022 and 5 August 2022, Mr Coulthard provided false installer written statements claiming he was the accredited installer or supervisor of 12 solar PV system installations.

The Clean Energy Regulator found that Mr Coulthard did not attend the installations and failed to meet the Clean Energy Council’s onsite requirements for a person responsible for installing or supervising a solar PV system installation.

David Coulthard has been declared ineligible to install small generation units for the purposes of sub-regulation 20AC(2) of the Regulations for a period of 12 months.

Greenbot agent suspension

We permanently suspended Greenbot Pty Ltd as a registered person on 11 June 2024. This decision was effective from 18 October 2024 after the Federal Court of Australia lifted a stay placed on the decision. As a result of this suspension, Greenbot can no longer create renewable energy certificates.

Greenbot withdraws challenge of Clean Energy Regulator decisions

We have consented to the discontinuation of Federal Court proceedings brought by Greenbot. The proceedings challenged our decisions to suspend Greenbot as a registered person in the in the Renewable Energy Target (RET) and to terminate their deed to be an app provider in the Solar Panel Validation (SPV) initiative.

Greenbot has also withdrawn its application to the Administrative Review Tribunal seeking a review of our decision to suspend its registration.

This means the suspension we imposed on 11 June 2024 will remain and Greenbot can no longer create renewable energy certificates.

On 9 July 2025, we will also terminate Greenbot’s deed, and Greenbot will no longer be an app provider under the SPV initiative. Participants have until 11:59 pm on 8 July 2025 to submit any outstanding certificate creations using the Greenbot app to us.
